***THIS REGISTRATION IS FOR VOLUNTEER ATTORNEYS ONLY*** The 1102 Guardianship Assistance Clinic takes advantage of Chapter 1102 of the Texas Estates Code. This section indicates that when there is a concern regarding an individual over 18 potentially needing guardianship the concerned party can submit an 1102 information letter to the Court.
This 1102 information letter lets the Court know that there is an individual in the community at risk who needs guardianship. This prompts a Court-Initiated Procedure to Appoint Guardian.
To complete this investigation, the Court appoints a Guardian Ad Litem (GAL). This is an attorney who investigates the situation and determines if guardianship is needed. If the GAL determines a guardianship is necessary, they next determine who would be an appropriate guardian or guardians. The GAL then completes the application for guardianship. The Court also appoints an Attorney Ad Litem (AAL) for the proposed ward.
Court fees, attorney fees for the assigned Guardian Ad Litem (GAL) and Attorney Ad Litem (AAL) should be covered by the Bexar County Court system. These funds that support this program are city funds designated to assist low-income individuals who cannot afford the associated court fees. Families must demonstrate need by completing an affidavit of inability to pay.
